Terms and Conditions / Guarantee

  1. It, as a result of the surveyors’ report, the contract cannot be carried out by the reason of its
    nature or incorrect pricing, the customer will be informed either that the contract cannot be
    carried out and is cancelled or that it can be carried out at an amended price. Within five days
    receiving notice of an amended price, the customer may cancel the contract by sending written
    notice to that effect by recorded delivery to the company. If the contract is cancelled pursuant to
    this condition by the company or the customer, the deposit paid by the customer will be
    returned in full. The company will try to fulfil the contract as reasonably possible but this will
    not be the essence of the contract.
  2. Representative samples are used to demonstrate a typical product and its composition. Fascias,
    guttering, flat roofs and soffits shown in the contract will be measured and manufactured in the way considered suitable by the company and pursuant to the company’s policy of continuous
    improvements to its products and reserves the right to make any necessary modifications. The
    goods supplied do not necessarily correspond to such display models.
  3. The customer shall grant the company’s employees and agents access to the premises at
    reasonable times for the purpose of taking measurements and carrying out the work specified.
    The company accepts no responsibility for any damage resulting from structural or other defects in the property at which the installations are carried out. The customer shall be responsible for the removal of all external fittings that are considered necessary in the opinion of the company’s installers to enable the installation to be carried out.
  4. All works is guaranteed under a workmanship guaranteed only materials are not covered under
    our guarantee The Guarantees are between 1 & 10 years from the installation date. The
    guarantee does not cover any damage or faults caused by events beyond our control such as fire, criminal damage, storm damage, and acts of war. Under this guarantee, liability will not be
    accepted if any attempt is made to carry out any repair or adjustment by any person other than the company’s accredited service agents.
  5. Where the customer is a customer (as defined by the unfair contract terms act 1977) nothing of
    these rights shall affect their statutory rights.
  6. The customer may cancel this contract by giving written notice no later than the close of
    business on the fourteenth day on which this contract was signed. If after the fourteenth day the
    customer cancels and no survey has taken place, the company will be entitled to charge the
    customer fifty five percent of the contract value. If after the fourteenth day the customer cancels and a survey has taken place, the company will be entitled to charge the customer seventy five percent of the contract value where ordering and manufacturing has begun/or goods have been paid for.
  7. If you wished to exempt yourself from the 14 day cooling off period for works to start
    immediately you can do this by sending an email to abuildabovetherest@gmail.com stating you are happy to wavier your rights to the 14 day cooling off periods.
  8. The customer is responsible for obtaining any necessary license, permit, planning permission /
    buildings regs or authority required by law for the installation of goods.
  9. Guarantee’s are not transferable.
  10. All electrics / locks / handles / sealed units / downpipes / outlets / guttering/clips and unions are
    guaranteed for 1 year. Any defects in glass & window profiles must be reported directly to the
    office within 7 days, following the completion of works.
  11. Condensation – we do not enter into any mitigation or in anyway however its caused as A Build
    Above The Rest Ltd hold no responsibility.
  12. When fitting an internal conservatory cladding the outside exterior roof Prestige Midlands Ltd are not liable for any leaks off this – A Build Above The Rest Ltd hold no responsibility.
  13. If an installation problem is reported and an Installer attends the property but the problem isn’t
    a part of the installation & workmanship carried out by A Build Above The Rest Ltd; there will be a £200 call-out fee charged.
  14. All Fascia / Soffit / Driveways / Roofs / Flat Roofs / Windows and Doors / Thermal Rendering;
    carry a 1 -10 year guarantee on workmanship only.
  15. An EPDM Roof is a flexible system that is designed to move under different temperature and
    weather conditions. Very occasionally, bubbles may appear; also pooling / ponding may occur. This is in no way detrimental to your flat roof or guarantee.
  16. When doing any roofing works hairline cracks or internal wall or ceiling damage can occur
    during the installation and the duration of the guarantee A Build Above The Rest Ltd hold no
    responsibility for any of this or costs involved. It is also the customers responsibility to cover
    up or remove belongings in the loft and to clear up dust or materials dropped or left as this is
    not A Build Above The Rest’s responsibility.
  17. A Build Above The Rest Ltd require full balance to be paid on the day of the installation. The
    installers are to collect payment before leaving the job. This is to be paid to the installer if in cash or (bank transfer). Scaffolding and skips can be left for up to 5 working days after full payment is received. This is in case any work is to be rectified after completion.
  18. Any damages occurred by scaffolding or skips are not at the responsibility of A Build Above
    The Rest Ltd and is to be taken up with the contracted scaffolder or skip company involved.
  19. When a customer has an advertising board up on behalf of A Build Above The Rest Ltd it is the
    customers responsibility to have this removed.
  20. When doing a flat roof, reroof, FSG windows or rendering work, due to the age of some
    properties / timber / brickwork, this can impair the look of the above products due to the
    brickwork and timbers that lie underneath.
  21. Due to the lack of products available in the UK market at present time, the products sourced
    may be a like for like alternative and not the ones shown in our brochures/presenters. This will
    not affect workmanship or guarantees.
  22. With PVC doors, patio doors & French doors, these do swell in the heat and above average
    temperatures; and can cause slight problems with the locking system. This is not detrimental to
    the product.
  23. On strip offs ie flat roofs or re-roofs at times we are unable to see if rafters or joists are
    structurally safe until roof is striped off, if the timbers were to need replacing we would take
    photo evidence and an additional cost would be applied.
  24. Any materials delivered to site becomes the clients responsibility A Build Above The Rest ltd
    accepts no liability if materials were to be damaged or stolen.
  25. Our prices are based on normal excavation a further charge will, apply if we have to dig down
    further due to clay or any rocky ground also a further cost will apply if there has been anything
    covered up underneath ground that is not visible to the eye during survey.
  26. Resin jobs stage payments / Guarantees.
    1. 1 year Workmanship Guarantee does not cover dry steering and is very important when driving your vehicle onto the drive that you do not dry steer as this could pull up the resin.
    2. Movement, expansion or contraction of sub-soil or sub-base due to, (but not limited to), climatic changes, tree root activity, underground drains, mine-workings, earthquake and changes to the local water table are outside the control of the contractor, therefore the guarantee does not cover damage caused by these or related factors.
    3. We follow the regulations for the installation of a resin drive or patio, to help prevent water from puddling but we can not 100% guarantee you will not get puddling.
    4. Weeds: Resin driveways are majority weed free but as seeds can grow on top of the surface from being blown around in the air we recommend a light power wash once a year to remain keeping your driveway in prestige condition.
    5. Guarantee: skips or any other heavy waste bins or heavy vehicles on your driveway will completely void your guarantee as these driveways are not designed for that purpose and only designed for cars or less stated otherwise in your quote.
    6. Down payment £100 to secure work date.
    7. 50% of balance to be paid once area has been dug out and stone has been laid.
    8. 40% of remaining balance to be paid once concrete has been laid. Resin jobs stage payments / Guarantees
    9. Remaining balance to be paid on completion of works.
  27. Concrete imprint jobs stage payments / workmanship guarantee:
    1. Down payment £100 to secure work date.
    2. 50% of remaining balance to be paid once area has been dug out and stone has been laid.
    3. 40% of remaining balance to be paid once concrete has been laid.
    4. Remaining balance to be paid on completion of works.
    5. 5 year Workmanship guarantee does not cover air line cracks or colour fade.
